1. Agreement

These terms are an agreement between you and MindDeserves ("we", "us"). By creating an account or using the platform you accept these terms, our Privacy Policy, and, if you receive clinical services, the Informed Consent for Telehealth Services.

2. What MindDeserves is (and is not)

MindDeserves is a software platform. We provide standardised assessment and screening tools, and the infrastructure through which independent professionals, schools, and organisations deliver their own services to the people they serve. We license the software; we do not provide the care.

MindDeserves is a platform, not a healthcare provider. The professionals on MindDeserves are independent practitioners, not our employees. All clinical judgement, advice, and care comes from the professional, who is solely responsible for it, including for holding the licence required to deliver it. We verify a professional's stated qualifications at onboarding, but you should independently verify any provider's credentials with the relevant registration body, and you choose your provider at your own discretion.

Two kinds of support, kept distinct:

• Clinical services (diagnosis, therapy, treatment, and the clinical interpretation of results) are delivered only by professionals licensed to practise in your own jurisdiction (in the United States, a provider licensed in your state). That professional, or their organisation, holds the licence and is responsible for the care.
• Wellbeing support (coaching, psychoeducation, and non-clinical guidance) may be offered by trained wellbeing practitioners who are not licensed clinicians. Wellbeing support is not therapy, diagnosis, or treatment, and wellbeing practitioners are presented as such, never as a "psychologist", "therapist", or "counselor".

Providers may be located in a different country than you; your provider's profile shows their qualifications and location. Nothing on MindDeserves is a substitute for in-person medical or psychiatric treatment where that is required.

3. Not an emergency service

MindDeserves is NOT a crisis or emergency service. If you or someone you know is in immediate danger, call your local emergency number (999 in the UK, 911 in the US, 112 in the EU) or go to the nearest emergency department. Do not wait for a platform response.

4. Accounts and eligibility

• You must provide accurate information and keep your credentials secure. You are responsible for activity on your account.
• You must be at least 18 to hold your own account. Under-18s use MindDeserves through a parent/guardian account with recorded guardian consent.
• Professional accounts require proof of qualifications and registration, are subject to our verification and ongoing conduct review, and may be suspended if verification fails or conduct standards are breached.
• Schools and organisations. When a school or organisation enrols its members (for example students) and creates accounts for them, that organisation confirms it has the authority to do so and that it has obtained, or will obtain before any screening, any parental or guardian consent required under the laws that apply to it. The organisation, not MindDeserves, is responsible for collecting, holding, and evidencing that consent; MindDeserves provides tools to record it but does not verify each individual consent. The organisation must give each enrolled member their own login and must not share one credential across members.

5. Assessments

• Assessments on MindDeserves are standardised instruments scored against their published scoring rules.
• An assessment result is a screening signal, not a diagnosis. Only a qualified professional can interpret results in context and form a clinical opinion.
• Certain answers indicating safety risk automatically alert your professional (see the Privacy Policy, Section 4).
• The free anonymous screening tools are for self-information only and store no data.

6. Fees, billing, and taxes

• Individuals: creating an account and the public screening tools are free. In-depth assessments come through your practitioner, school or organisation and are included in their plan; nothing is charged per assessment. Consultations show their price before you book; payment is taken securely before the session. Prices shown to consumers include applicable tax; a tax invoice/receipt is issued for every charge.
• Professionals and organisations: platform access is by subscription, billed by invoice (payable online or by bank transfer) on a monthly or annual cycle. Every school and organisation plan starts with a 15-day free trial; the first invoice is due when the trial ends, and an invoice left unpaid after its due date pauses access after a short grace period until it is settled. An active subscription covers platform usage as described in the plan. Business prices are shown exclusive of tax, which is added or reverse-charged per the invoice. Cancelling stops renewal; access continues to the end of the paid period.
• Consultation fees are set by each professional and shown when booking.
• Cancellations and refunds: appointments cancelled less than 24 hours before the scheduled time may incur the provider's cancellation fee. Duplicate charges and payments for services not delivered are refundable, contact [email protected]. Statutory consumer rights in your country are not affected by anything in these terms.

7. Acceptable use

You agree not to: misuse or attempt to break the platform's security; access data that is not yours; impersonate others or misrepresent qualifications; harass users or professionals; scrape or copy assessment content (which is licensed or proprietary material); or use the platform for any unlawful purpose. We may suspend accounts that do.

8. Intellectual property

The platform software, design, reports, and MindDeserves-authored assessment content are owned by or licensed to us. Published clinical instruments remain the property of their respective copyright holders and are used under their applicable terms. You retain ownership of your own data; you grant us only the licence needed to operate the service for you, as described in the Privacy Policy.

9. Disclaimers and liability

• The platform is provided with reasonable skill and care, but no online service is uninterrupted or error-free.
• Clinical care is the responsibility of the treating professional, not MindDeserves. We are not liable for clinical decisions, advice, or outcomes of care provided by independent professionals.
• To the maximum extent permitted by law, our total liability to you in any 12-month period is limited to the amount you paid us in that period. Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or your statutory consumer rights.

10. Termination

You may close your account at any time (see the Privacy Policy for data deletion). We may suspend or terminate accounts for breach of these terms, with notice where practicable. Sections that by their nature survive (fees owed, liability limits, IP) survive termination.

11. Governing law

These terms are governed by the laws of India, and disputes are subject to the courts of India, except that if you are a consumer (in the UK, EU, United States, or elsewhere) you keep the protection of the mandatory consumer laws, and access to the courts, of your country or state of residence.

12. Changes

We may update these terms; material changes will be notified in the app or by email before they take effect. Continued use after the effective date is acceptance of the updated terms.
